Terms of use
These terms apply to the free service. If paid offers (e.g. server hosting) are added later, additional terms will apply to them.
1. Scope and provider
These terms of use govern the use of the Minecraft launcher “Asto”, the Asto account, the online features that come with it and the website astocraft.de (together, the “Service”).
The provider is Wilko Eggen, Horumer Str. 41, 26607 Aurich, Germany (see the legal notice). The Service is operated privately, not by a company, and is free of charge.
By registering an account or using the online features, you agree to these terms. Any different terms of yours do not apply.
2. What we provide
We provide the following to you free of charge:
- the “Asto” launcher for starting and managing Minecraft,
- an Asto account,
- online features: friends (friends list and online status), cosmetics (e.g. colored names), online backups of your profiles with a storage quota per account, and an update service for the launcher and the client mods,
- the websites astoclient.com and astocraft.de.
The range of features may change: features may be added, changed, restricted or removed. You have no claim to particular features. We do not guarantee that the Service is available at all times or free of interruptions (see section 10).
The name “Asto”, the logo and the design of the Service belong to the provider. These terms give you no rights to them, other than the right to use the Service as described here.
3. Account and registration
- You need an account for the online features. You can register if you are at least 14 years old or have the consent of your parents or legal guardians. By registering, you confirm that this requirement is met.
- The details you give when registering must be correct. Keep them (especially your email address) up to date.
- One account per person is allowed. You may not pass your account on to others, sell it or share it.
- Keep your credentials (password, sign-in codes) secret. We recommend turning on two-factor authentication (2FA). If you suspect that someone else has access to your account, change your password immediately and let us know.
- You are responsible for everything that is done under your account, unless you are not responsible for the misuse.
4. Permitted use and prohibited conduct
You may use the Service only within the law and these terms. In particular, the following is not allowed:
- cheats, hacks and any manipulation of the Service, e.g. forged requests to our servers, tampered versions of the launcher, or faking an online status or someone else’s account;
- attacks on our servers or on other people’s accounts, e.g. overloading, automated mass queries, trying out other people’s credentials or exploiting security vulnerabilities. Please report security vulnerabilities to kontakt@astocraft.de;
- misuse of names and cosmetics, e.g. impersonating another person, or using the names of players or protected brands to deceive or to infringe the rights of others. When registering, give only your own Minecraft name;
- unlawful, insulting, discriminatory or youth-endangering content in usernames, display names and other labels you enter;
- backups containing data you have no rights to, unlawful content or malware; you back up only your own data;
- circumventing quotas and technical limits, e.g. by creating additional accounts to get more storage;
- harassing other users, e.g. through mass friend requests.
5. Content and online backups
- Your content (e.g. worlds, settings, screenshots, mod configurations) remains yours. You grant us only a simple, non-exclusive right to store this content for you and to restore it on your request or make it available for you to download. The right ends when the content is deleted.
- You are responsible for the content of your worlds and backups, including complying with third-party rights (e.g. copyright in builds, mods and resource packs) and with the law. We do not check the content.
- Each account has a storage quota, and there is also a size limit per backup. You can see both in the launcher and in your account. When the quota is full, you cannot create new backups until you have freed up space. If we change the quota, we will, where reasonable, give you the chance to download your backups beforehand.
- You can delete backups yourself at any time, in the launcher or in your account on the website. If your account is deleted, your backups are deleted as well (see section 9).
- Backups are a convenience and not a substitute for your own backup. We recommend that you also back up important worlds yourself.
6. Minecraft, Microsoft and Mojang
- Asto is an independent project and is not affiliated with Mojang Studios or Microsoft. Mojang Studios and Microsoft do not endorse or approve Asto.
- For Minecraft, the Minecraft End User License Agreement (EULA) and the Microsoft terms of service apply in addition. You must comply with them.
- To play, you need a valid Minecraft account (a Microsoft account with a Minecraft license). Asto does not sell Minecraft and does not make it possible to play without a license.
- Asto downloads the Minecraft files from the servers of Mojang and Microsoft. We do not modify these files and do not provide them ourselves.
- “Minecraft” and other trademarks mentioned belong to their respective owners.
7. Mods and third-party content
The launcher can display and install mods, modpacks, resource packs, shader packs and other third-party content, e.g. via Modrinth. This content does not come from us.
- The licenses and terms of the respective creators and platforms apply to third-party content. You must comply with them.
- We do not check third-party content for functionality, security or lawfulness, and we are not liable for it, except as provided otherwise in section 11.
- You use third-party content at your own risk. Mods can affect the game or damage saved games, so create a backup first. Some servers prohibit certain mods.
8. Recordings
With the “Asto Replay” feature, you can record clips of your game (video and sound). The clips are stored locally on your PC only; nothing is uploaded (see the privacy policy).
- You are yourself responsible for your recordings and for storing, passing on and publishing them.
- The game audio may contain the voices of other players, e.g. from a voice chat. Recording, and especially passing on or publishing, may require the consent of your fellow players. Secretly recording the privately spoken word may be a criminal offense under Section 201 of the German Criminal Code (StGB); personality rights and data protection may also be affected.
- Follow the rules of the server in question. Some servers prohibit or restrict recording. You can turn recording off at any time in the settings.
9. Suspension and termination
- You can stop using the Service and terminate your account at any time. To do so, send an email to kontakt@astocraft.de; we will then delete your account without undue delay. Download any backups you want to keep beforehand.
- We may suspend or delete an account, temporarily or permanently, if you violate these terms or the law, or if this is necessary to protect the Service or other users. In doing so, we take into account the severity of the violation and your legitimate interests and, where reasonable, give you the opportunity to comment beforehand. The right to terminate for good cause remains unaffected.
- When the account is deleted, your account data and the backups stored on the Asto server are deleted, unless we are required by law to retain them (see the privacy policy). If an account is suspended because of a violation, we will try to let you download your backups on request, provided the violation does not concern exactly this content and there are no legal reasons against it.
- Data stored locally on your PC stays with you. The online features are no longer available after the account has been deleted or suspended.
10. Availability, changes and discontinuation of the Service
- The Service is free of charge and operated privately. We provide it without any guarantee of a particular availability. Outages, maintenance, updates and disruptions, including those caused by third parties (e.g. the hosting provider, Mojang, Microsoft, Modrinth), are possible.
- We may change, restrict or discontinue the Service or individual features.
- If we discontinue the entire Service, we will announce it with reasonable notice (on the website, in the launcher or by email), where this is reasonable, and give you the opportunity to download your backups.
11. Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, for fraudulently concealed defects and where we have given a guarantee.
(2) In cases of slight negligence, we are liable only if we breach an essential contractual obligation (a so-called cardinal obligation). These are obligations whose fulfillment is a prerequisite for the proper use of the Service in the first place and on which you can regularly rely. In that case, liability is limited to the foreseeable damage typical for this kind of contract. Otherwise, liability for slight negligence is excluded.
(3) Because we offer the Service free of charge, the statutory liability privileges for services provided free of charge (e.g. Sections 521 and 599 of the German Civil Code, BGB) remain unaffected, to the extent they apply to the service in question. Paragraph 1 remains unaffected.
(4) For loss of data, within the limits of the paragraphs above, we are liable only for the effort that would have been needed to restore the data had you made regular backups of your own, appropriate to the risk.
(5) We assume no liability for services and content of third parties (sections 6 and 7), unless we are at fault ourselves.
12. Privacy
How we handle personal data is described in the privacy policy.
13. Changes to these terms
- We may change these terms with effect for the future if there is an objective reason (e.g. new or changed features, a change in the law, or preventing abuse) and the change is reasonable for you.
- We will notify you of the change at least four weeks before it takes effect, on the website, in the launcher or by email. Within this period you can object to the change by email to kontakt@astocraft.de. If you do not object and keep using the Service after the period has ended, the changed terms are deemed accepted. We will point this out specifically in the notice.
- Changes that materially alter the core of the services or the balance between performance and consideration, or impose significant new obligations on you, apply only with your express consent (e.g. by confirming at your next sign-in). For such material changes you may also terminate with immediate effect until they take effect and ask for your account to be deleted.
- If you object to a change, the previous terms continue to apply until the change takes effect. After that, we may end the usage relationship if the Service cannot be continued under the previous terms.
14. Final provisions
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country where you have your habitual residence remain unaffected.
- The place of jurisdiction is Aurich, to the extent permitted by law (e.g. for merchants and legal entities under public law). For consumers, the statutory places of jurisdiction apply.
- If any provision of these terms is or becomes invalid in whole or in part, the rest remains valid. The statutory rule takes the place of the invalid provision.
- These terms are available in German and English. In case of differences, the German version prevails.
